Article 113: Entry Into Force and Staggered Application
Article 113 sets the staggered timeline for the AI Act's application: prohibitions from February 2025, GPAI and governance rules from August 2025, most other provisions from August 2026, and high-risk obligations originally from August 2026 and August 2027. Regulation (EU) 2026/1744, the Digital Omnibus on AI, entered into force on 27 July 2026 and amended this timeline, pushing the Annex III high-risk date to December 2027, the Annex I product-safety route to August 2028, and adding a transitional deadline of December 2026 for the Article 50(2) synthetic-content marking duty on systems already on the market.
- 01 Aug 2024 AI Act enters into force
- 02 Feb 2025 Article 5 prohibitions and Article 4 AI literacy duty apply
- 02 Aug 2025 GPAI obligations (Chapter V) and governance/penalty framework apply
- 02 Aug 2026 Most remaining provisions apply, including Article 50(1)/(3)/(4) and Article 50(2) for newly placed systems
- 02 Dec 2026 Transitional deadline for Article 50(2) marking on systems already on the market before 2 August 2026, added by Regulation (EU) 2026/1744
- 02 Aug 2027 National regulatory sandboxes obligation for member states, shifted from 2 August 2026 by Regulation (EU) 2026/1744
- 02 Dec 2027 Annex III high-risk obligations apply (Art. 6(2)), shifted from 2 August 2026 by Regulation (EU) 2026/1744
- 02 Aug 2028 Annex I product-safety-route high-risk obligations apply (Art. 6(1)), shifted from 2 August 2027 by Regulation (EU) 2026/1744
- Track the current, amended timeline rather than any pre-July-2026 summary of Article 113 dates.
- Distinguish provisions unaffected by the Digital Omnibus (Article 5 prohibitions, GPAI Chapter V, most of Article 50) from those it rescheduled (Annex III and Annex I high-risk routes, Article 50(2) for legacy systems, national sandboxes).
- Reconfirm applicable dates for any given obligation against its own article page rather than assuming a single Act-wide date.
2 August 2026 is often treated as "the day the AI Act starts"; the Act actually entered into force in August 2024 and applies in staggered waves running from February 2025 through August 2028, several of which the Digital Omnibus has now moved further out.
